Trump’s a Loser Again in Court

Trump can’t seem to slow down the lawsuits against him and keeps adding to his losing record of court decisions. This time again, his loss was his federal court appeal that claimed he had immunity after she claimed to have been raped by him. The Washington D.C. Court of Appeals has just clarified its position in response to Trump’s filing in Carroll's defamation lawsuit.

A federal appeals court had chosen to decline to rule on whether then-President Donald Trump was acting within his scope of employment when he allegedly defamed writer E Jean Carroll in her ongoing lawsuit scheduled to go to trial later this month in which she claims after she claimed to have been raped by Donald J. Trump. The Washington D.C. Court of Appeals clarified its position in response to Carroll's defamation lawsuit…

"We have never adopted a rule that has determined that a certain type of conduct is per se within (or outside of) the scope of employment, and we decline to do so now,"

Trump's legal team argued before the court that Trump could not be sued because he was acting in his official capacity when he said that he would not have raped Carroll because she was not his "type."

This ruling makes clear that Carroll's original lawsuit can proceed after the appeals court ruling.
