Trump Screwed: Appeals Court Refuses to Stop Pence from Testifying

Trump’s attempt to prevent his former Vice President Mike Pence from testifying to the January 6 investigation being led by special counsel Jack Smith was rejected by a federal panel for the D.C. Court of Appeals.

The former twice impeached, criminally indicted, and defeated president’s only option is to try to stop Pence from testifying is a last-ditch appeal to the U.S. Supreme Court, which has repeatedly rejected his executive privilege claim. In the past, the Supreme Court has issued one-line rejections to his appeals.

CNN’s Katelyn Polantz, who has been covering Trump’s legal filings in a desperate attempt to stop the former Vice President from testifying, said...

"The former president has repeatedly tried and failed to close off some answers from witnesses close to him in the special counsel’s investigation. This latest order from the DC Circuit Court of Appeals likely will usher in Pence’s grand jury testimony quickly – an unprecedented development in modern presidential history,"

"The unanimous decision, from Judges Patricia Millett, Robert Wilkins, and Greg Katsas on the DC Circuit, came in a sealed case on Wednesday night that CNN previously identified as Trump’s executive privilege challenge to Pence."

Katsas is a Trump appointee, while Millett and Wilkins are appointees of former President Barack Obama.

"Trump asked the DC Circuit for emergency intervention weeks ago. The court refused to put Pence’s subpoena on hold and override the lower-court ruling, flatly denying Trump’s requests," noted the report. "

Meanwhile, Pence initially resisted efforts to testify in the probe, arguing that the Speech and Debate Clause of the Constitution privileges the conversations that he had on that day as President of the Senate, overseeing the counting of electoral votes. However, after a federal judge ordered him to comply with Smith's subpoena, Pence declined to challenge the order and agreed to cooperate.

If Pence confirms Trump and his minions’ repeated attempts and their campaign to compel him to overturn the 2020 election illegally. Trump and all involved could be staring down indictments for conspiracy and sedition.

The newly released tape recordings of Senator Ted Cruz (R-TX) could implicate him and 11 other Republican Senators in the conspiracy to overturn the 2020 Presidential election illegally.
